Avoiding Liens in Chapter 7
In a chapter 7, if the Debtor has a home with negative equity, he or she can file motions to avoid judgment liens recorded against the same property that is underwater. This has been an extremely helpful tool for our clients at Bandari Law Group. Many clients have very old judgments from a difficult time in their past. Creditors sue people, obtain judgments, record them against debtor’s properties, then sit back and let them accrue interest. At Bandari Law Group we have the ability to file a Chapter 7, then file a motion to avoid or remove these old judgments so they no longer incumber the property. Call us so we can discuss our strategy in greater detail and prepare a plan for you and your loved ones.
